Terms of Use

By downloading, installing, or using SmackMac ("the Software"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Software.

You must be of legal age in your jurisdiction to use SmackMac. Some sound packs contain content not suitable for minors. By purchasing or using the Software, you confirm that you meet the minimum age requirement under applicable law. The developer assumes no responsibility for use by minors and disclaims liability arising from underage access.

SmackMac is a novelty macOS application that detects physical impacts to your MacBook using the built-in accelerometer and plays audio responses. It is provided for entertainment purposes only. It is not a security system, monitoring service, or theft-recovery service.

You use SmackMac entirely at your own risk. The Software encourages users to physically strike their MacBook. The developer expressly disclaims responsibility for damage to your hardware, including but not limited to cracked or scratched displays, damaged hinges or enclosures, malfunctioning keyboards, trackpads, or sensors, voided warranties, data loss from physical impact, and any other physical or functional damage.

While the software itself cannot do any harm, slapping can. By using SmackMac, you acknowledge that striking a computer is inherently risky and that you are solely responsible for any consequences.

To the maximum extent permitted by law, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Software, including loss of profits, data, hardware, goodwill, or other intangible losses, even if advised of the possibility of such damages.

In no event shall the developer's total liability exceed the amount you paid for the Software.

The Software is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant uninterrupted, error-free, or harm-free operation.

You expressly acknowledge that using the Software involves deliberate physical force against your device. You assume all risk of damage, injury, or loss that may result from using the Software as intended or otherwise.

The developer is not liable for social, professional, reputational, or personal consequences from using the Software in workplaces, schools, public spaces, or private gatherings — including disciplinary action, embarrassment, or damaged relationships. You are solely responsible for when, where, and around whom you operate the Software.

You agree to indemnify, defend, and hold harmless the developer from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Software or violation of these Terms.

You receive a personal, non-transferable, non-exclusive, revocable license to use the Software on devices you own or control. You may not redistribute, reverse-engineer, decompile, or create derivative works based on the Software except as allowed by law.

The SmackMac name, logo, brand colors, visual design, website content, audio assets, and associated materials are the exclusive intellectual property of the developer. All rights not expressly granted are reserved. Unauthorized use of SmackMac intellectual property may be pursued to the fullest extent permitted by law.

SmackMac builds on ideas and approaches inspired by open source work, including spank by Tai Groot (MIT License). Use of third-party open source components does not imply endorsement by their authors.

If the Software fails to function on a supported device, email dovud.husan@gmail.com and we will work to resolve the issue or provide a refund. No refunds will be issued for hardware damage resulting from use of the Software. We may ask for a short video showing the issue to help diagnose the problem. Purchases are processed via Polar; refunds are handled in coordination with that checkout flow where applicable.

SmackMac requires macOS 14 (Sonoma) or later on Apple Silicon (M2 or newer, or M1 Pro specifically among M1 variants). The developer is not responsible for issues on unsupported hardware or OS versions.

SmackMac does not collect, transmit, or store personal sensor data from your device. Accelerometer data is processed locally and is not sent to our servers. Checkout and licensing are handled by Polar; their privacy policy governs payment and license-related data (such as email for your purchase receipt and license key delivery).

If you purchase SmackMac, your email may be collected as part of the transaction (via Polar). By completing a purchase, you may receive occasional product updates or related announcements from us at dovud.husan@gmail.com. You can ask to unsubscribe at any time by emailing that address. We will not sell or rent your email for third-party marketing.

The developer may modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
